1. General Information and Website Ownership

These General Terms and Conditions govern the purchase of the products offered through this website. Placing an order constitutes the customer’s full, express and unreserved acceptance of each and every one of these terms and conditions.
2. Prices and Taxes
All prices shown on Denisurf.es are expressed in euros (€) and include the corresponding Value Added Tax (VAT) in accordance with applicable Spanish and European legislation.
• Prices do not include shipping costs. Due to the nature of technical and sports equipment, shipping costs are calculated individually and will be shown separately in the shopping cart before the customer completes payment.
• Denisurf.es reserves the right to change its prices at any time. However, products will always be invoiced at the rates in force at the exact moment the customer confirms the order.
3. Availability and Out-of-Stock Items
The products offered on the website are subject to stock availability. Should a purchased product be unavailable due to a stock shortage or an inventory discrepancy, Denisurf.es will notify the customer of the issue as soon as possible.
• The customer will be offered a substitute product of similar characteristics and quality, or the option to cancel the order.
• If the order is cancelled due to lack of stock, the amount paid for the product will be refunded. In accordance with our Returns Policy, any fees or commissions charged by the payment gateway selected by the customer are non-refundable.
4. Shipping Policy, Delivery Times and Destinations
Denisurf.es handles the shipping of its products under the following commercial terms:
• Shipping areas: We ship throughout the European Community (European Union) and to the Balearic Islands.
• Shipping costs: Denisurf.es does not offer free shipping. Shipping costs are not fixed; they are calculated automatically and individually based on the weight/volume of the product (such as boards, kites or wetsuits) and the destination country or town.
• Delivery times: The final delivery time will depend on the carrier selected during the checkout process. However, the usual estimated delivery time for orders is between 3 and 5 business (working) days from the moment the parcel leaves our premises. Denisurf.es is not liable for exceptional delays caused by courier companies beyond our control.
5. Accepted Payment Methods
To ensure maximum security in transactions, Denisurf.es offers users the following payment methods:
• Credit or debit card: Processed securely through a banking payment gateway.
• Stripe: Secure platform for card payments and integrated digital services.
• PayPal: Secure electronic payment system (subject to the platform’s terms and conditions).
• Bank transfer: The order will be processed once the payment has cleared in our bank account. To speed up the process, the customer must send proof of payment to info@denisurf.es stating their order number.
Important note on payments: Any fees, surcharges or processing commissions charged independently by these payment platforms will not be refunded by Denisurf.es in the event of returns, withdrawals or cancellations due to lack of stock.
6. Legal Guarantees
All technical products and sports equipment sold on Denisurf.es are covered by the manufacturer’s applicable legal guarantee.
• The guarantee covers solely and exclusively manufacturing defects in the item. Damage resulting from misuse, impacts, cuts, improper handling, incorrect storage or natural wear caused by water, salt or prolonged exposure to the sun is entirely excluded from any coverage.
• To initiate a guarantee claim, it is mandatory to provide the invoice or purchase receipt and the product’s serial number, if it has one.
• As stipulated in the store’s policies, all transport, logistics and shipping costs for sending the product to our premises for the physical assessment of the guarantee claim shall be borne entirely by the customer.
7. Applicable Law and Jurisdiction
These terms and conditions shall be governed by and construed in accordance with Spanish law. For the resolution of any dispute, conflict or legal controversy that may arise in connection with purchases made on Denisurf.es, the parties expressly submit to the competent Courts and Tribunals of Dénia (Alicante), Spain, unless the applicable consumer protection legislation mandatorily establishes a different jurisdiction.
